Welcome to the website of NGC AUS GROUP PTY LIMITED and NGC FUND HOLDING PTY LTD, and any subsidiaries, (“we”, “us” or the “Company”), hereafter referred to as “NGC”.
This website is located on the web via the domain https://www.ngcorporate.com.au/ and includes all of the files located in that domain (“this site”).

By applying to invest in any NGC fund, you consent to information about you being used by NGC for the purposes of providing investment services.

NGC and its related entities respect the importance of protecting the privacy of our investors and others with whom we conduct business. We comply with the requirements of the Privacy Act 1988 (Cth) and adopt the Australian Privacy Principles within the Act in protecting all personal information we hold.

Why we collect information

We collect personal information to perform our functions and business activities. This includes providing customers with requested products and services offered by us and external providers for whom we act as agent, complying with our legal obligations (for example, anti-money laundering and counter-terrorism financing laws), maintaining investments and dealing with investor queries.

Information we may collect

The type of information we collect includes names, address, date of birth, bank account details, contact details, financial information and documents required by law. We may take steps to verify the information we collect.

How we collect information

We only collect personal information about you directly from you unless it is unreasonable or impracticable to do so, you have instructed us to liaise with someone else or we use third parties if required to comply with law. In most cases, we will seek your consent which may be withdrawn at any time: if consent is not given, we may not be able to provide you with products or services.

If we receive unsolicited personal information, we will only retain it if necessary for our functions and activities and that you consent to the information being collected: otherwise, we will destroy or de-identify the information.

Security of personal information

We are committed to ensure that we protect any personal information we hold from misuse, interference, loss, unauthorised access, modification and disclosure and we have a range of practices and policies in place to provide a robust security environment. Where information we hold is identified as no longer needed for any purpose, we will destroy it.

Use or disclose of personal information

We will not use or disclose personal information other than for the purpose of its collection, unless you have consented, you would reasonably expect us to use it, it is required by Australian law or its use is by an enforcement body.

Who we may communicate with

Dependent upon the product or service you have, we may exchange your personal information with parties not limited to including brokers and agents who refer your business to us, affiliated and external product and service providers for whom we act as agents, our external auditors, persons acting on your behalf, your referee, credit reporting agencies, financial institutions from whom you’re seeking credit, parties involved in securitised products, organisations working with us to provide you products and services and professional associations.

Outsourcing

We disclose personal information when we outsource functions including bulk mailing, market research, direct marketing, banking agents, debt recovery and information technology support, and from experts improving our systems. In all such instances, confidentiality arrangements are in place with use limited to only our purposes.

Disclosure required by law

We may be required to provide your personal information by law, for example, for taxation, social security, sanctions, anti-money laundering or counter-terrorism financing purposes.

Direct Marketing

We will only disclose your personal information for direct marketing of our products and services to you if we receive this information from you and you haven’t requested not to receive such marketing information.

Cross border disclosure of personal information

We will only disclose your personal information to a recipient who is not in Australia, and who is not associated with our own entities, after we ensure circumstances including that the recipient does not breach the Australian Privacy Principles (“APP”) or you have access to protection by a law upholding similar principles to the APP or you have consented to the disclosure or disclosure is required by Australian law or court/tribunal orders.

Access to personal information

You can request access to your personal information held by us, with provision within 14-30 days. Access charges may apply.

Whilst we will endeavour to give you access to personal information you request, in  particular circumstances, by law, we may deny or limit your access and provide you with an explanation. You have a right to have any inaccuracies corrected, unless we refuse, whereby we will provide you with reasons for refusal.
